COH Cigars — Terms and Conditions

1. Welcome & Acceptance

Welcome to COH Cigars (hereinafter referred to as "CoH", "we", "us", or "our"), operated by The International Marketing Exchange Limited (Company No. 0001876), with its registered address at 601 Car Po Commercial Building, 18–20 Lyndhurst Terrace, Central, Hong Kong.

 

These Terms and Conditions ("Terms") form a legally binding agreement between you ("you", "your", or "Customer") and CoH and govern your access to and use of the website located at cohcigars.com and any subdomains, mobile applications, communications channels, and services we operate (collectively, the "Site").

 

Please read these Terms carefully before using any CoH service. By visiting, browsing, registering an account, placing an order, or otherwise using any CoH service, you:

 

•         Certify that you are above the legal age for tobacco use in your jurisdiction (and in any event, no younger than 18 years of age);

•         Acknowledge and consent to our data privacy practices as set out in our Privacy Policy;

•         Acknowledge that you have read, understood, and agree to be bound by these Terms; and

•         Confirm that you are entering into these Terms on your own behalf and have the legal capacity to do so.

 

If you do not agree with any part of these Terms, please exit the Site immediately and do not use any CoH service.

 

2. Hong Kong Regulatory Compliance

CoH operates in accordance with the laws of the Hong Kong Special Administrative Region, including without limitation the Smoking (Public Health) Ordinance (Cap. 371) and the Dutiable Commodities Ordinance (Cap. 109). Specifically:

 

•         We operate in accordance with the Smoking (Public Health) Ordinance (Cap. 371) of Hong Kong.

•         We do not sell tobacco products to individuals under the age of 18.

•         We do not offer or distribute alternative smoking products (including e-cigarettes, vapes, or heated tobacco products), which are prohibited under Hong Kong law.

•         All tobacco products supplied by us are duty-paid and comply with all applicable Hong Kong packaging and labelling regulations.

 

You acknowledge that smoking is harmful to health and that all tobacco products carry the statutory health warnings required under Hong Kong law.

 

3. Habanos S.A. Disclosure & Sourcing

With respect to all Habanos S.A. products, CoH is an independent reseller and is not affiliated with, authorised by, or endorsed by Habanos S.A., its parent companies, or any of its official distributors. CoH is not an authorised distributor, official agent, franchise holder, licensee, or subsidiary of Habanos S.A. or any company within its global distribution network.

 

For other brands, CoH may operate as an authorised retailer or wholesale customer of the relevant manufacturer or distributor. The nature of our relationship with each brand owner varies and is not represented or warranted by any general statement on the Site. Where you require confirmation of our supply status for a particular brand, please contact info@cohcigars.com.

 

Our prices, availability, allocation, packaging condition, and commercial terms are set entirely at our own discretion.

 

3.1 Trademarks & Brand Names

All brand names, trademarks, trade names, vitola names, and logos referenced or displayed on the Site — including but not limited to Cohiba, Montecristo, Partagás and all other Habanos S.A. marques, as well as any other brand names — are the exclusive property of their respective owners.

 

These marks are used on the Site solely for the purpose of accurately identifying and describing the products we sell. Such use does not imply, suggest, or constitute:

 

•         Any affiliation, association, partnership, or commercial connection between CoH and the relevant brand owner or manufacturer;

•         Any endorsement, sponsorship, certification, or approval of CoH, its services, or its products by any brand owner or manufacturer;

•         Any authorisation by the brand owner for CoH to act as an official retailer, distributor, or representative; or

•         Any claim of ownership of the relevant trademarks by CoH.

 

3.2 No Manufacturer Warranty (Habanos S.A. Products)

Because CoH is an independent reseller of Habanos S.A. products and is not part of Habanos S.A.'s authorised distribution network, Habanos S.A. products sold by CoH do not carry, and are not eligible for, any manufacturer warranty, guarantee, recall remedy, exchange, or replacement programme offered by Habanos S.A. or its official distributors.

 

For other brands, manufacturer warranty coverage (if any) depends on the specific brand and supply channel and is not represented or guaranteed by CoH except as expressly stated on the relevant product listing. Any warranty, where offered, is provided exclusively by CoH at our sole discretion and is limited to the terms expressly stated on the Site or in writing.

 

4. Eligibility & Age Verification

You represent and warrant that you are at least eighteen (18) years of age, or such higher age as is required for the lawful purchase, possession, and use of tobacco products in your jurisdiction of residence and the destination jurisdiction. CoH reserves the right at any time, in its sole discretion, to require proof of age and identity, and to cancel any order or close any account where such proof is not furnished to our satisfaction.

 

You further represent and warrant that:

 

•         You are purchasing tobacco products solely for your own personal use, or as a gift to another adult of legal age, and not for resale;

•         You are not purchasing on behalf of, or for delivery to, a minor;

•         You are not located in, and the products will not be shipped to, any jurisdiction in which the sale, importation, or possession of the products is unlawful; and

•         You will accept delivery in person or arrange for an adult of legal age to accept delivery on your behalf.

 

5. Ordering & Payment

5.1 Order Placement

By placing an order, you agree that your payment method will be authorised for the full order amount at the time of checkout. Your card will be charged on the day your order is dispatched, or shortly thereafter.

 

Placing an order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email confirming dispatch. Order acknowledgements, receipts, or status updates do not, by themselves, constitute acceptance of your offer.

 

5.2 Pricing & Errors

We do not guarantee the accuracy of any materials on the Site, including but not limited to pricing, product descriptions, photographs, vitola information, or availability. CoH reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order has been submitted. We are not bound to honour any price, sale, promotion, or offering that was uploaded or displayed in error.

 

5.3 Discretion to Cancel

CoH reserves the absolute right, in its sole discretion and without giving reason, to refuse, limit, or cancel any order at any time, including after payment has been processed. This includes, without limitation, orders that we believe in good faith to be fraudulent, non-compliant with these Terms, restricted by allocation, restricted by export or import law, or commercially unreasonable. Where an order is cancelled prior to dispatch, our sole obligation is to refund any amount actually charged.

 

5.4 Chargeback Policy

By placing an order with CoH, you agree to contact CoH customer service at info@cohcigars.com before initiating any chargeback or dispute with your card issuer or payment provider. You acknowledge that initiating a chargeback without first attempting to resolve the matter directly with us is a material breach of these Terms and may result in:

 

•         Immediate and permanent termination of your account;

•         Permanent ban from future purchases on the Site;

•         Recovery of all costs incurred by CoH in defending the chargeback (including bank fees, administrative costs, and reasonable legal fees); and

•         Referral to law enforcement and credit reporting agencies where the chargeback is determined to be fraudulent.

 

5.5 Duties, Taxes & Customs

By placing an order, you acknowledge and agree that you are solely and fully responsible for any duties, taxes, levies, customs charges, and clearance procedures imposed by your local authorities or the destination jurisdiction. Such charges are not included in product or shipping prices and are payable directly by you to the relevant authority or carrier. CoH is not responsible for, and will not refund, any such charges under any circumstances.

 

6. Delivery

6.1 Dispatch & Lead Times

Orders are generally dispatched one to two business days after receipt. During peak demand, public holidays, or operational disruptions, dispatch may take up to seven (7) business days or longer. Estimated delivery times provided on the Site or by carriers are estimates only and are not guaranteed.

 

6.2 Cancellation Window

You may cancel your order at any time before it has been marked dispatched by contacting info@cohcigars.com. Once an order has left our warehouse, it cannot be cancelled and must be processed under the Resolution Process in Section 7.

 

6.3 Self-Pickup Restrictions

We do not currently support delivery to SF Express self-pickup points or any third-party pickup locations. Orders requiring such delivery may be cancelled at our discretion.

 

6.4 Risk of Loss

Title to and risk of loss in the goods passes to you upon dispatch from our warehouse to the carrier. From that point onward, the goods travel at your risk, subject only to our Resolution Process in Section 7.

 

6.5 Address Accuracy

You are solely responsible for providing a complete, accurate, and deliverable address. CoH will not be responsible for non-delivery, mis-delivery, or delay caused by inaccurate, incomplete, or outdated information provided by you, and no refund or reshipment will be offered in such circumstances.

 

7. Resolution Process

7.1 Refund or Reship

Delivery is guaranteed subject to the conditions in this Section 7. In the event of non-arrival of your order, we will, at our sole discretion, either reship or refund your order. A package is considered lost only if:

 

•         It does not arrive within twenty-eight (28) working days of dispatch; and

•         It has had no tracking scan within fourteen (14) working days of your written complaint.

 

7.2 Damage in Transit

For items damaged in transit, you must notify us at the time the goods are received and provide photographs of the damaged cigars and packaging within forty-eight (48) hours of delivery. Damaged items must be returned to us at our cost upon request, and we will reship or refund the order at our sole discretion.

 

To return any box or item, please contact us at info@cohcigars.com to obtain an RMA (Return Merchandise Authorisation) number and return instructions. Returns sent without an RMA number may be refused or unprocessed.

 

7.3 Time Limit on Claims

No claims for compensation, refund, reship, or any other remedy will be accepted more than ninety (90) days after the date of dispatch. This is a strict limitation period and applies regardless of when the issue arose or was discovered.

 

7.4 Tariffs, Duties & Taxes

Under no circumstances will CoH refund, reimburse, or compensate customers for tariffs, duties, taxes, customs fees, brokerage charges, or any similar charges levied by any authority.

 

8. What Is Not Covered

The following situations are not covered under our Refund or Reship policy, and no refund or reshipment will be offered:

 

(a) Incomplete or incorrect delivery address. If the address provided is found to be incomplete, inaccurate, or undeliverable, no refund or reship will be offered.

 

(b) Customs refusal due to non-payment of duties. If a package fails to clear customs because you refuse, fail, or are unable to pay the applicable duties, taxes, or excise charges, no refund or reship will be offered. If goods are returned to us as a result, a $50 USD restocking fee (or local-currency equivalent) will apply. Repeat occurrences will result in account termination.

 

(c) Untracked shipping methods. If you opt for an untracked or non-tracked shipment method, no refund or reship will be offered for any reason whatsoever.

 

(d) Variance in flavour or taste. Cigars are an artisanal product made from naturally grown leaf. Variation in flavour, draw, burn, construction, colour, and aroma between cigars, batches, vintages, and even within a single box is inherent and expected. We do not accept claims, returns, or refund requests based on subjective taste, flavour profile, draw, or smoking experience.

 

(e) Sealed boxes. If you opt for a sealed box and are dissatisfied with its internal condition, we will not be liable for the condition of the contents or for any return cost, as we were not given the opportunity to inspect the contents prior to dispatch.

 

(f) Habanos S.A. products, including without limitation any claim relating to authenticity certification by Habanos S.A., authorised distribution, Habanos S.A. warranty coverage, Habanos S.A. recall participation, tax stamp variance, packaging differences, labelling differences, or customs compliance arising from the unauthorised distribution status of such products.

 

(g) Customs seizure, confiscation, or destruction of goods by any authority in any jurisdiction.

 

(h) Force majeure events as defined in Section 16.

 

9. Fraud Prevention

We take fraud extremely seriously and have implemented a series of fraud prevention measures.

 

•         If your order is suspected of being fraudulent, it will be automatically held until a member of our team has reached out to you for verification. Failure to respond within seven (7) days will result in cancellation.

•         Any person who engages in, attempts, or facilitates fraudulent credit card activity on the Site will be prosecuted to the full extent of the law in all applicable jurisdictions and will be liable for all losses, costs, and reasonable legal fees incurred by CoH.

•         Any person who fraudulently claims non-delivery, damage, or shortage may be subject to investigation with the postal/courier authority, charged-back, and referred for civil and/or criminal action.

•         We reserve the right, at our sole discretion, to share information related to suspected fraud with law enforcement, payment networks, and other merchants.

10. Customs Inspection Notice

Please note that due to customs regulations, some products may have been opened by Hong Kong customs or destination-country customs for inspection purposes. While this may result in outer packaging or seals being opened, all products are genuine and supplied to you in their original brand-new condition. Customs inspection is outside our control and is not grounds for a refund or return.

 

11. Account Registration & Security

Where you register an account on the Site, you agree to:

 

•         Provide accurate, current, and complete information;

•         Maintain and promptly update your account information;

•         Maintain the confidentiality of your account credentials and accept responsibility for all activity under your account; and

•         Notify us immediately of any unauthorised use of your account.

 

CoH may suspend or terminate any account, at any time, in its sole discretion, including for breach of these Terms, suspected fraud, or misuse of the Site. You have no proprietary right in your account, and termination of your account is without liability to CoH.

 

12. Acceptable Use

You agree not to use the Site to:

 

•         Violate any law, regulation, or third-party right;

•         Resell, redistribute, or commercially exploit products purchased from CoH without our prior written consent;

•         Use any automated means (including bots, scrapers, or crawlers) to access or extract data from the Site;

•         Interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure;

•         Attempt to gain unauthorised access to any account, system, or data;

•         Submit false, misleading, or defamatory content; or

•         Impersonate any person or entity.

 

Breach of this Section 12 constitutes a material breach of these Terms and may result in immediate suspension or termination of your account and legal action.

 

13. Intellectual Property

All content on the Site — including text, graphics, photographs, logos, page layouts, code, and software — other than third-party trademarks identified in Section 3.1, is the property of CoH or its licensors and is protected by copyright, trade mark, and other intellectual-property laws. You are granted a limited, revocable, non-transferable licence to view and use the Site for personal, non-commercial purposes only. Any other use, including reproduction, modification, distribution, scraping, or republication, is strictly prohibited without our prior written consent.

 

13.1 Our Registered Trademarks

The marks "COH", "COH Cigars", and "COH House" are registered trademarks in the Hong Kong Special Administrative Region, owned by our parent company, The International Marketing Exchange Limited. All rights in these marks, together with any associated logos, stylisations, taglines, get-up, and trade dress, are reserved.

 

Any unauthorised use, reproduction, imitation, registration, or commercial exploitation of the COH, COH Cigars, or COH House marks — including without limitation use as part of a domain name, social media handle, business name, product name, metadata, advertising, or in a manner likely to cause confusion as to source, sponsorship, or affiliation — is strictly prohibited and will be prosecuted to the full extent of the law, including by way of trademark infringement and passing-off proceedings, in Hong Kong and any other jurisdiction in which our rights are infringed. We will seek all available remedies, including injunctive relief, damages, account of profits, costs, and legal fees.

 

14. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

 

CoH expressly disclaims all warranties, conditions, and representations of any kind, whether express, implied, statutory, or otherwise, including without limitation:

 

•         Any warranty of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement;

•         Any warranty arising out of course of dealing, course of performance, or trade usage;

•         Any warranty that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;

•         Any warranty as to the accuracy, completeness, or reliability of product descriptions, photographs, vitola sizes, ring gauges, country of origin, vintage, or condition; and

•         Any warranty that products will meet your expectations regarding flavour, draw, burn, construction, ageing, or smoking experience.

 

Without limiting the foregoing, with respect to Habanos S.A. products, CoH offers no Habanos S.A. manufacturer warranty, no Habanos S.A. distributor warranty, and no implied warranty of conformity with Habanos S.A. specifications, as we are not part of Habanos S.A.'s authorised distribution network. Any warranty offered by CoH is provided exclusively by CoH at our sole discretion and is limited as expressly set out on the Site.

 

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CoH AND ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

 

•         Indirect, incidental, special, exemplary, consequential, or punitive damages;

•         Loss of profits, revenue, business, goodwill, data, or anticipated savings;

•         Loss arising from loss of use, business interruption, or substitute goods or services;

•         Personal injury, illness, or health-related claim arising from the use of any tobacco product (including without limitation any claim relating to nicotine, smoking, secondhand smoke, or any condition associated with tobacco use); or

•         Any claim arising from the unauthorised distribution status of Habanos S.A. products, the unavailability of Habanos S.A. manufacturer warranty, or any difference between Habanos S.A. products sold by CoH and Habanos S.A. products sold through authorised distribution channels,

 

arising from or related to your use of the Site, your purchase or use of any product, or these Terms, regardless of the cause of action and regardless of whether CoH was advised of the possibility of such damages.

 

To the fullest extent permitted by law, CoH's aggregate liability to you for all claims arising from or related to these Terms, your use of the Site, or any product purchased from us shall not exceed the lesser of: (a) the total amount actually paid by you to CoH for the specific product or transaction giving rise to the claim during the three (3) months immediately preceding the event giving rise to liability; or (b) HKD 1,000 (or local-currency equivalent).

 

You acknowledge that the foregoing limitations are an essential basis of the bargain between you and CoH and that, without them, our prices would be substantially higher.

 

16. Force Majeure

CoH shall not be liable for any delay, failure to perform, or non-performance of any obligation under these Terms where such delay or failure is caused by circumstances beyond our reasonable control, including without limitation: acts of God, natural disasters, fire, flood, earthquake, typhoon, pandemic, epidemic, public health emergency, war, civil unrest, terrorism, strike, labour dispute, embargo, government action, regulatory change, customs delay or seizure, courier or postal service failure, internet or telecommunications failure, power failure, supplier failure, or shortage of materials.

 

17. Indemnity

You agree to defend, indemnify, and hold harmless CoH, The International Marketing Exchange Limited, and our officers, directors, employees, agents, affiliates, suppliers, and licensors from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable legal fees) arising out of or related to:

 

(a) Your access to or use of the Site;

 

(b) Your breach of these Terms or any representation, warranty, or covenant made by you;

 

(c) Your violation of any law, regulation, or third-party right (including without limitation any tobacco-control law, customs regulation, age-restriction law, or import/export regulation in any jurisdiction);

 

(d) Any claim arising from the unauthorised distribution status of Habanos S.A. products, including without limitation claims relating to authenticity, authorised distribution, Habanos S.A. warranty coverage, Habanos S.A. support, tax stamps, labelling, recalls, country of origin, or customs compliance for such products;

 

(e) Your purchase, possession, transport, gift, resale, or use of any product purchased from CoH;

 

(f) Any personal injury, illness, addiction, or health-related claim asserted by you or any third party arising from the use of any product purchased from us; and

 

(g) Any claim by a customs authority, tax authority, or law-enforcement agency in any jurisdiction relating to your importation or possession of any product purchased from us.

 

This indemnity survives termination of these Terms and your account.

 

18. Governing Law & Dispute Resolution

18.1 Governing Law

These Terms, your use of the Site, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles.

 

18.2 Exclusive Jurisdiction

You agree that the courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of the Site, and you irrevocably submit to the personal jurisdiction of such courts.

 

18.3 Class Action Waiver

To the fullest extent permitted by law, you and CoH each agree that any claim shall be brought in your or our individual capacity only, and not as a plaintiff or class member in any purported class, collective, representative, multi-plaintiff, or consolidated action. You expressly waive any right to participate in a class action against CoH.

 

18.4 Time Limit on Claims

Any cause of action or claim you may have arising out of or relating to these Terms, the Site, or any product must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action or claim is permanently barred, to the fullest extent permitted by applicable law.

 

18.5 Equitable Relief

Notwithstanding anything to the contrary, CoH may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or to enforce these Terms.

 

19. Translation & Language

These Terms are written in English. In the event of any discrepancy, conflict, or inconsistency between these Terms and any translation, the English-language version shall prevail.

 

20. Customer Compliance

You are solely responsible for compliance with all laws, statutes, ordinances, regulations, and customs requirements applicable to the purchase, importation, possession, and use of tobacco products in your jurisdiction. Tobacco regulations are complex and frequently changing. We strongly recommend that you investigate your local laws thoroughly before placing an order. By placing an order, you certify that doing so, and the importation and possession of the goods, is lawful in your jurisdiction.

 

21. Changes to These Terms

CoH reserves the right to modify, update, or replace these Terms at any time, in our sole discretion, by posting the revised Terms on the Site with an updated "Last Updated" date. Where changes are material, we will use reasonable efforts to notify you (for example, by email or by a prominent notice on the Site).

 

Your continued use of the Site or placement of any order after the effective date of any revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

 

22. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and CoH and supersede all prior agreements, understandings, and communications, whether written or oral.

 

Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, or, if no such modification is possible, severed; the remaining provisions shall continue in full force and effect.

 

No Waiver. Our failure to enforce any provision shall not constitute a waiver of that or any other provision.

 

Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. CoH may assign these Terms freely, including to any affiliate or successor.

 

No Third-Party Beneficiaries. These Terms are for the sole benefit of you and CoH and confer no rights on any third party, except that the indemnified parties in Section 17 are intended third-party beneficiaries of that section.

 

Headings. Section headings are for convenience only and have no legal effect.

 

Status Acknowledgement. For the avoidance of doubt and without prejudice to Section 3, CoH is an independent reseller of Habanos products and is not an authorised distributor.

 

Notices. All notices to CoH shall be in writing and sent to info@cohcigars.com. All notices to you may be sent to the email address associated with your account or order.
